  REGARDING DRY CELL, FACTORY ACTIVATED, MAINTENANCE FREE, AND AGM 12 volt BATTERIES:
  Advanced Battery Systems has no obligation under the limited warranty herein in the event a 12v Lead Battery is damaged or destroyed as a result of one or more of the following:
  
  
• Willful abuse, misuse, physical damage, neglect or if the top battery cover has been removed.
• Natural forces such as wind, lightning, hail; damage due to fire, collision, explosion, vandalism, theft, penetration or opening of the Battery case in any manner.
• Overcharging, undercharging, charging or installing in reverse polarity, improper maintenance, allowing the Battery to be deeply discharged via a parasitic load or mishandling of the Battery such as but not limited to using the terminals for lifting or carrying the Battery. Trickle chargers that do not have a regulated trickle charge voltage between 13.5V and 13.8V (no lower than 13.5V and no higher than 13.8V) will cause early failure of the Battery. Use of such chargers with the Battery will also void the Battery¡¦s warranty. For applications where an alternator is present, the alternator must deliver between 14.0V and 14.7V when measured at the Battery¡¦s terminals. Alternators that do not have a regulated charge between 14.0V and 14.7V (no lower than 14.0V and no higher than 14.7V) will cause early failure of the Battery. Use of such alternators with the Battery will also void the Battery¡¦s warranty.
• Failure to properly install the Battery or lack of metal jacket for high temperature or vibration applications.
• Repair or attempted repair of the Battery by anyone other than an authorized Manufacturer's representative shall void this warranty.
• Normal or accelerated deterioration in the electrical qualities due to operating or application conditions.
• If the Battery is used for an application that requires higher cranking power or a greater reserve rating than the Battery is designed to deliver, or the Battery capacity is less than the Battery capacity specified by the vehicle manufacturer, or the Battery is otherwise used in applications for which it was not designed.
• Prolonged storage of vehicles with fuel injection computers, alarms, GPS and other electrical devices that require continuous battery power to support active memories; this power drain must be offset with a maintenance-float charger, periodic charging or disconnecting the Battery to prevent irreversible damage. A Battery with an open circuit voltage (OCV) of equal to or less then 8.0V will be deemed as over discharged and void warranty due to misuse and/or neglect.
• WARNING - DO NOT USE ANY TYPE OF OIL, ORGANIC SOLVENT, ALCOHOL, DETERGENT, STRONG ACIDS, STRONG ALKALIS, PETROLEUM-BASED SOLVENT OR AMMONIA SOLUTION TO CLEAN THE BATTERY COVERS AND BATTERY TOPS. THESE MATERIALS MAY CAUSE PERMANENT DAMAGE TO THE BATTERY COVERS BATTERY TOPS AND WILL VOID THE WARRANTY.
  
  
  ** Since many Radio-Controlled and Airsoft applications often exceed cell manufacturer’s recommended maximum discharge rates, there is no warranty (expressed or implied) by the manufacturer, its Distributor and Retailers in the respect to the Life Cycle, Capacity, Cell Characteristics or Storage of cells/packs used in the Radio-Controlled or Airsoft market. By purchasing this battery, the buyer/user assumes all risks associated with Lithium Polymer batteries. If you do not agree with these conditions, return the battery to the store where you purchased for a refund/exchange before using.
  
  ***Advanced Battery Systems can provide warranty service for Odyssey Batteries only if such items were purchased from Advanced Battery Systems or through our website www.BatteryPrice.com. Any Odyssey battery returned to Advanced Battery Systems for warranty service must have the original Odyssey brand label with appropriate manufacturer's date code, serial number, product identification and must have a serial number intact and legible from Advanced Battery Systems. Customer must pay for all shipping and insurance costs associtated with the return of any Odyssey branded product, this includes costs to ship the product to Advanced Battery Systems and costs to ship any repaired or replacement products back to the customer, regardless of warranty disposition. Advanced Battery Systems reserves the right to refuse warranty service on any Odyssey branded product which does not meet our return policy guidelines. All electronics, batteries or battery assemblies sold under the this warranty are under warranty for the periods listed above, measured from the date of purchase by the first end user. Under this warranty, any ABS battery found to be defective due to improper workmanship or material will be repaired or replaced without charge. The repaired or replacement product is warranted for the balance of the original warranty period. Warranty is VOID if serial number is removed, or if battery is charged using non-specified charger. When a rechargeable battery is considered for warranty, we will warrant the battery to exhibit 80% or higher of the originally specified battery capacity (mAh or CCA) for the periods specified above.

Return Procedure:
If an Advanced Battery Systems product must be returned, please call (800) 634-8132 for a Return Merchandise Authorization Number (RMA#). The RMA# must be printed on the outside of package being returned. All shipping charges must be paid by the original purchaser. Advanced Battery Systems must be notified of invoice and/or shipping discrepancies within 15 days of invoice date. No returns will be accepted for refund or credit after 30 days of invoice date.

POWER TOOL BATTERIES MUST BE RETURNED WITHIN 15 DAYS OF INVOICE DATE FOR REFUND OR CREDIT CONSIDERATION. ANY RETURN OF POWER TOOL BATTERIES AFTER 15 DAYS WILL BE CONSIDERED FOR WARRANTY REPLACEMENT OR REPAIR ONLY.

Warranty does not cover: a) defects due to repair, modification, service, or alteration by any party other than ABS, Inc., b) defects due to customer abuse/misuse, c) failure of plastic case due to improper handling, d) individual battery cells (all chemistries), e) non-rechargeable batteries.

Return Policy
Returns will not be accepted unless previously authorized and are subject to a 15% restocking charge. Non-rechargeable batteries (Alkaline, Lithium, Carbon Zinc, Silver Oxide, etc.) are non-returnable, non-refundable. Advanced Battery Systems must be advised of any discrepancies within 15 days of invoice date. Custom made product, non-rechargeable batteries, and individual cells are non-returnable and non-refundable (this includes all chemistries). No returns will be accepted after 30 days from date of shipment, unless for Warranty purposes. Any item which is to be considered for refund must be unused and in resalable condition.

Money Back Guarantee Policy
If a product description on our website indicates a money back guarantee, then the following conditions apply:

• Item(s) must be returned within 15 days of purchase (unless product description clearly states a 30 day money back)
  
• Customer must adhere to the return procedure above
• Customer must clearly state the reason for dissatisfaction before returning the item(s)
• No money will be refunded for product that has been misused or abused
• No money will be refunded for product that has been used, marked, or is not in resalable condition.
• If a customer's reason for dissatisfaction is performance related and we find that the returned item is not performing per specifications, then a full refund will be issued. If our product does perform as expected (80% or higher than rated capacity), then a refund will not be issued and the product will be returned to the customer.
• The Money Back Guarantee does not apply to non-rechargeable batteries (alkaline, primary lithium, silver oxide, etc.)
  

USE OF PRODUCT POLICY
Advanced Battery Systems shall not be liable for any misuse of the goods. Goods are not designed for use in critical systems such as medical, aircraft, emergency, warning or safety devices. Seller shall not be liable for any injury, lost profits, delays or other consequential damages resulting from any defect or failure of the goods to perform as expected. A buyer accepts all such risk.

GENERAL WARRANTY
Warranties: Advanced Battery Systems (seller) makes no warrant that its goods conform to any state, federal, or local law or industrial code, including, but not limited to, the requirements of the Occupational Safety and Health Act, as amended, it being expressly agreed that Buyer shall be responsible for compliance therewith. There are no warranties of merchantability or of fitness for a particular purpose. Buyer agrees to indemnify and hold harmless from any and all liability, loss or damage which seller may suffer as a result of claims, demands, costs, or judgements against seller arising out of any use whatsoever of the goods sold pursuant to this Agreement, which liability, loss or damages, claims, demands or judgements are based upon or result from, (1) the failure of the Buyer, Buyer's officers, Agents or employees to follow manufacturers instructions, warnings or recommendations; (2) the failure of the Buyer, Buyer's officers, Agents, or employees to comply with Federal, State or local laws or regulations applicable to the use of the Goods, including, but not limited to the Occupational Safety and Health Act as amended; or (3) any liability, loss or damages, claims, demands, costs or judgements based upon or resulting from any negligence or alleged negligence of Seller or any of the Seller's officers, Agents or Employees in the sale of Goods subject to this Agreement; or (4) liability or liability without fault applied to Buyer or to Seller or the original manufacturer of the Goods or to any party who sold the Goods to Seller; or (5) liability, loss or damages, claims, demands, costs of judgements based upon or resulting from any theory of breach of warranty of any kind.
